  • Can I dismiss an employee I have an issue with ?

    As an employer you can take any action you wish.

     

    However failure to follow the correct disciplinary process will more than likely end up with the business being taken to tribunal and facing a very expensive award which could be an unlimited amount.

  • I’ve been told if an employee has less than 2 years service they cannot take me to tribunal?

    Yes, employees with less than 2 years service do have fewer rights when it comes to making a tribunal claim for unfair dismissal.


    However, even if an employee has less than 2 years service, if they can demonstrate automatic unfair dismissal or discrimination they can still take their employer to tribunal.  



  • What are the biggest mistakes made by employers undertaking disciplines?

    The biggest mistakes made by employers when dealing with employee issues is failing to follow the correct process.

    • Failure to properly document the issues / process
    • Failure to properly investigate all allegations 
    • Lack of written communication with the employee
